General terms of sale and delivery

1. Applicability

These general terms and conditions apply to all deliveries and services provided by Justwedi.nl. Deviating and/or additional agreements shall only be binding if expressly confirmed in writing by Justwedi.nl. Justwedi.nl is part of De Bouwmarktshop.nl.

2. Orders and payments

All payments must be made in advance. Once a payment has been processed by the bank, it will be visible to Justwedi.nl in real time. After receipt of payment, Justwedi.nl will proceed with delivery of the ordered goods.

All sales on delivery are expressly subject to the condition that the agreed price is based on the cost factors applicable at the time the agreement is concluded. These include, among others, export duties in the country of origin, freight and insurance costs, unloading costs, import duties, levies and taxes. All delivered goods shall remain the property of Justwedi.nl until the full invoice amount has been paid.

3. Payment and delivery options

Justwedi.nl holds the Trusted Shops quality mark. This certification guarantees that you can pay online safely and reliably.

Available payment methods include:

• Direct payment via the webshop (iDEAL)
• Payment via payment link (iDEAL by email)
• Bank transfer based on invoice
• Klarna – pay afterwards
• In3 – payment in three instalments
• Credit card payment
• Payment via construction deposit (invoice for bank purposes)
• Invoicing for your customer (for professionals)
• Biller – post-payment for business customers

Through our payment provider Mollie, you can also pay securely using:

4. Delivery costs

Packaging and/or shipping costs will be charged for the careful packing and shipment of wedi materials. For deliveries to other countries, costs are calculated individually and are available on request. Please refer to the ‘Delivery costs’ section for more information.

5. Delivery and risk

Until the moment of delivery, the risk of damage or loss of the goods rests with the seller. After delivery, the risk and responsibility transfer to the buyer.

• The seller is obliged to transport the goods to a location accessible by a properly passable vehicle. The buyer is obliged to accept and unload the goods at that location. Any resulting costs due to failure to do so shall be borne by the buyer.
• The seller determines the means of transport unless otherwise agreed.
• Orders will be delivered within 30 days unless stated otherwise. Product-specific delivery times are listed with the product and delivery always takes place in consultation.
• Delivery takes place within the Netherlands, excluding the Wadden Islands. Different conditions apply for deliveries to the Wadden Islands and abroad. Goods will be delivered to the front door where possible. For apartment buildings, delivery will be to the central entrance.
• Someone must be present at the time of delivery to receive the goods. After receipt, the risk of damage or theft lies entirely with the recipient. If no one is present, the costs for a second delivery attempt will be fully charged to the client.

6. Right of withdrawal

You have the right to withdraw from the agreement within 14 days after receipt of the goods without stating any reason. To exercise this right, you must inform us by means of an unequivocal statement (for example by email or in writing).

You may use the model withdrawal form, but this is not mandatory.

In the event of withdrawal, all payments, including standard delivery costs, will be refunded within 14 days. We may withhold reimbursement until we have received the goods or proof of return.

Custom-made products, hygienic products with broken seals and products that are inseparably mixed are excluded from the right of withdrawal.

7. Warranty

Warranty shall lapse if defects arise due to improper use, careless processing, modifications by third parties or use for purposes other than intended. Warranty claims must always be supported by the original invoice.

8. Offers and quotations

All offers and quotations are non-binding and valid while stocks last, unless stated otherwise. Quotations are personal and non-transferable.

9. Complaints and defects

The consumer is obliged to inspect the delivered goods for defects and completeness upon delivery. Any defects and/or shortages must be reported in writing to Justwedi.nl within five days after delivery, stating the customer and invoice number.

If a defect is not immediately visible, it must be reported within three days of discovery in the manner described above.

10. Quality

Unless expressly agreed otherwise at the time of sale, normal quality shall be delivered and normal commercial practices shall apply with regard to dimensions, quantities and units.

Delivery subject to inspection by management shall only take place if agreed in writing by the buyer and accepted in writing by the seller. Inspection must take place within two working days after receipt of the goods.

11. Retention of title

Justwedi.nl is not liable for consequential damage or damage caused by delayed delivery unless there is intent or gross negligence.

• Until the full invoice amount has been paid, Justwedi.nl remains the sole owner of the delivered goods.
• As long as ownership has not transferred to the buyer, the buyer may not pledge, transfer ownership or grant any other rights to third parties.
• The buyer is permitted to sell or deliver goods subject to retention of title in the normal course of business. In the event of breach, the full invoice amount becomes immediately due.
• The seller is granted access to reclaim the delivered goods where necessary.

12. Liability

Justwedi.nl shall never be liable for consequential damage and/or costs resulting from delayed deliveries. In the event defects are found, the warranty provisions apply.

If damage results from intent, gross negligence, improper use or culpable actions by the buyer or third parties, Justwedi.nl cannot be held liable.

13. Deviating conditions

Additional or deviating conditions are only valid if expressly confirmed in writing by the seller.

14. Disputes

All disputes shall be settled by arbitration, to the exclusion of the ordinary courts.

Where legally permitted, claims within the jurisdiction of the district court may be brought before that court at the claimant’s discretion.

The European Commission provides an online dispute resolution (ODR) platform at http://ec.europa.eu/consumers/odr. Justwedi.nl does not participate in dispute resolution procedures.

15. Force majeure

Force majeure includes all circumstances beyond the seller’s control which prevent fulfilment of the agreement, including weather conditions, strikes, government measures, transport disruptions and supply restrictions.

In the event of force majeure, the seller may extend the delivery period by up to six months or cancel the agreement in whole or in part.

16. Complaints

Complaints regarding goods that have been opened or processed in whole or in part will not be accepted.

17. Applicable law

All agreements are governed exclusively by Dutch law.

Justwedi.nl reserves the right to amend these terms and conditions if required by legal or regulatory changes.
